Terms and Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by participating all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

  1. The Promoter: Proximo Spirits UK, 26-28 Ely Place, London EC1N 6TD

  1. Eligibility: This prize promotion is open to UK (England, Wales, Scotland and Northern Ireland) residents aged 18 years or over excluding employees and their immediate families of The Promoter, associated agents or anyone professionally connected with the prize draw promotion. Internet access required. No purchase necessary.

  1. Promotional Period: The prize draw entry period opens at 00:00 01.06.25 until 23:59 30.09.25. All entries outside the Promotional Period will not be accepted.

  1. Entry Instructions: To enter the prize draw, scan the QR code on the bottle neck tag or visit winwithjosecuervo.co.uk to submit your details (full name, email address, contact number & date of birth) during the Promotional Period.

    Entry is via the microsite only (winwithjosecuervo.co.uk). Only one entry per person per week during the Promotional Period. For the avoidance of doubt, a person can enter only once per week.

    Any entrant using multiple identities or computerised or automated systems to enter the promotion will be disqualified and any prize void. Only one prize can be claimed per household.

    No third party or bulk entries. Entries via trade, third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent that either a participant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data, acting fraudulently or dishonestly in the opinion of the Promoter, using identities other than their own, creating fake identities or any other automated or manual means in order to increase that participant's or a household’s entries or otherwise acting in violation of these terms, these participants and their household will be disqualified, and any prize entitlement will be void.

    Incomplete, illegible, invalid or misdirected entries will not be accepted. Proof of sending will not be accepted as proof of entry. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed or not received for whatsoever reason.

  1. Prizes: Main prize will be 1 x 2.5ltr Ninja SLUSHi Frozen Drink Maker, 5 x available to be won. Runner up prize will be 1 x Jose Cuervo inflatable beachball, 25 available to be won. There are 30 prizes available to be won in total.

    No cash or other alternative prizes will be provided in whole or in part, except that in the event of circumstances outside of its control, the Promoter reserves the right to substitute a similar prize of equal or greater value. The prizes are non-transferable.

  1. Winner Selection: The 30 winners will be drawn at random via randomised computer process from all valid entries received during the Promotional Period, within 3 working days of the closing date of the Promotional Period. A winner will be redrawn if they have won previously or if there is a previous winner within their household. If multiple winners are selected from the same household, only the first entry will be accepted, and all other prizes will be redrawn.

  1. Winner Notification: The winners will be notified by the email address provided on entry within 2 working days of the draw date. It is the responsibility of the participant to ensure that they respond to the winner notification, by emailing the address provided at the point of notification with a scanned copy of their proof of full name, date of birth and home address. Only official documents can be accepted as proof of ID (passport or driving licence) and home address (utility bill less than three months old or bank statement, for example). A mobile phone bill will not be accepted as proof of home address.

    If a winner has not responded to the initial email notification by day 14 of initial prize notification, one attempt to telephone call them will be made using the contact number provided on entry. If contact cannot be made, a winner is ineligible, rejects their prize or their prize is not claimed, within 14 days of the initial prize notification, an alternative winner will be drawn using the same methodology as above. The process will repeat until an eligible winner is able to claim each prize for a period of 3 months, after which any remaining prizes will be declared null and void. Entrants are encouraged to monitor their email account, including junk mailbox during this time in case they are a winner. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion. The Promoter cannot be held responsible for any winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

  1. The prizes will be delivered via secure overnight delivery to each winner’s home address provided after valid claim and the completion of the verification process within 3 days. The notified winners are responsible for providing the correct name and email address on entry and when claiming any prize.

  1. The Promoter and/or the Agency accept no responsibility if a prize cannot be delivered for any reason outside of their control.

  1. The Promoter’s decision is final and binding. No correspondence will be entered into.

  1. The Promoter will make available the main prize winner’s surname and county of residence to members of the public or regulators who request such details within 3 months of the closing date of the Promotion Period. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting winwithjosecuervo@altavia-uk.com . We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winners list by emailing  winwithjosecuervo@altavia-uk.com. The Promoter reserves the right to refuse such requests.

  1. The Promoter reserves the right to verify all entries including but not limited to asking for proof of ID (passport, driving licence or equivalent). The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these Terms and Conditions or the spirit of the Promotion. Those who try and circumvent the entry process and/or entry instructions by any method or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means will be disqualified and any prize award will be void.

  1. Entry into the Promotion is at the entrant's sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter further disclaims liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these Terms and Conditions shall act to limit or exclude the Promoter's liability resulting from its negligence or fraud or for any liability which cannot be excluded by law (including personal injury, death and fraud).

  1. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

  1. The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Promotion or invalidate any entries in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions (including but not limited to global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God), the Promoter will not be liable for any failure to perform or delay in performing its obligations but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

  1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

    These Terms and Conditions shall be governed by the law of the relevant country for each entrant, and entrants submit to the exclusive jurisdiction of the courts of the relevant country they reside in.

  1. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose unless we have your consent. Your data will be passed onto a third-party fulfilment agency AltaviaUK for the purposes of administering the prizes. This data will be kept secure and in accordance with the requirements of current  Data Protection  legislation. Entrants' personal data will be used and held in accordance with the Promoter's Privacy Policy at https://www.winwithjosecuervo.co.uk/privacy and the agency’s Privacy Policy at www.altavia-hrg.com/privacy. Data will be stored for 3 months after the promotion end date then deleted. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to winwithjosecuervo@altavia-uk.com
